Legal fees should be understandable before representation begins. Bery Law explains the applicable fee structure, billing rate, retainer requirements, and scope of representation in writing before work begins.
How fees are structured
Consultation
Bery Law offers a free initial consultation of approximately 30 minutes. The consultation is an opportunity to briefly discuss your situation, identify the primary legal issues, and determine whether the firm may be able to assist. If more time or a more in-depth review is needed, we will discuss that with you before any additional fees are incurred.
Hourly billing
Many contested and litigation matters are billed hourly. Time is billed in accordance with the engagement agreement, and clients receive itemized invoices reflecting the work performed.
Flat fees
For some matters with a defined scope, Bery Law may offer a flat fee. Whether a flat fee is appropriate depends on the nature of the work and the scope of the engagement.
Retainers
Bery Law generally requires an advance retainer before representation begins. The amount of the retainer depends on the nature and expected scope of the matter. Retainer funds are handled in accordance with the engagement agreement and applicable professional rules and are applied to fees and expenses as work is performed. Any unearned funds remaining at the conclusion of the representation are returned as required.
Every engagement is confirmed in writing and explains the scope of representation, the applicable fee structure, and how billing will work.

The complexity of the dispute
Cases involving multiple claims, parties, properties, financial issues, or disputed facts generally require more attorney time than narrower matters.
The level of conflict and litigation involved
Costs can increase when issues cannot be resolved informally, extensive motion practice or discovery is required, or the matter proceeds toward trial.
Discovery and evidence
Document review, written discovery, depositions, and the volume of evidence can significantly affect the amount of work required.
Experts and the scope of representation
Some matters require appraisers, accountants, contractors, or other professionals who charge separately for their services. A limited engagement or negotiated matter may also require substantially less work than full litigation through trial.

What happens to money I pay up front?
That depends on the fee arrangement. Advance retainers for hourly matters are generally held in trust and applied to fees and expenses as they are earned. Flat fees may be treated differently depending on the engagement agreement. The written agreement will explain how any advance payment is handled.
Will I know what the fee arrangement is before work begins?

Do you take cases on contingency?
In some matters, a contingency arrangement may be available depending on the type of case and the circumstances. Most matters handled by Bery Law are billed hourly or on a flat-fee basis.
Can I pay by card, and are payment plans available?
Bery Law accepts major credit and debit cards and other electronic payment methods. Payment-plan options may also be available depending on the matter and the payment method selected.
What if I only want advice, not full representation?
Limited-scope assistance may be available depending on the matter. This can include a consultation, document review, contract work, negotiation, or another defined piece of legal work without full representation through litigation.
