Federal appeals from Tennessee

Appeals from the Eastern, Middle, and Western Districts of Tennessee are heard by the Sixth Circuit. The Court reviews decisions of the federal district courts rather than retrying the case or hearing the evidence from the beginning.

Federal appellate practice is different from trial-court litigation. Appeals generally focus on whether the trial court made a reversible legal or procedural error based on the existing record, and the issues that can be raised may depend on what occurred, and what was preserved, in the district court.

Appellate briefing and oral argument

Much of an appeal is driven by the written record and appellate briefs. Depending on the case, representation may involve reviewing the district-court record, identifying appealable issues, researching the applicable standard of review, preparing appellate briefs, and presenting oral argument when the Court schedules it.

The Sixth Circuit publishes oral-argument calendars and maintains its principal courthouse at the Potter Stewart U.S. Courthouse in Cincinnati.
