Parental Relocation
The statutory process that may apply after a parenting arrangement has been established when a parent plans to move outside Tennessee or more than 50 miles from the other parent.
Also called: move away
Tennessee has a specific relocation statute, and it requires notice rather than permission in the first instance. A parent intending to relocate must give the other parent written notice within the period the statute sets, containing the information the statute requires.
The other parent then has a defined window to file an objection. If no objection is filed in time, the move generally proceeds. If an objection is filed, the court decides based on the child’s best interest.
The notice requirements are technical and the deadlines are short on both sides. This is one of the areas where getting advice before acting, rather than after, changes the outcome most often.
