Declaratory Judgment
A court ruling that determines the parties’ legal rights or obligations, often used when the dispute concerns what a contract, deed, or other legal instrument means.
A declaratory judgment settles a question before it becomes a larger dispute. Rather than waiting for a breach and then suing for damages, a party asks the court to declare what an agreement requires, whether coverage exists, or who holds a particular right.
It is commonly used with contracts, insurance policies, deeds, easements, and governing documents such as HOA covenants.
The relief is a binding determination of rights. It can be sought on its own or alongside other claims, including a request for an injunction giving effect to the declaration.
