Demand Letter
A formal written notice setting out a claim and what is required to resolve it, usually sent before proceedings begin.
Also called: letter before action
A demand letter has three functions: it states the claim clearly, it creates a record, and it opens a route to resolution before the expense of litigation.
A good one sets out the facts, identifies the obligation breached, quantifies the loss, states what is required and by when, and does so without overstating the case. Overstatement is counterproductive, because the letter is a document that may be read back later in front of a judge.
Some contracts and some statutes make pre-suit notice a requirement rather than a courtesy, and failing to give it properly can delay or defeat a claim.
