Lien

A legal claim against property that may secure payment of a debt or obligation.

A lien attaches to property rather than to a person. It can arise by agreement, as with a mortgage or deed of trust; by statute, as with a mechanic’s or materialman’s lien for work performed; or by operation of law following a judgment.

For an owner, a lien is most often felt at the point of sale or refinancing, because it generally has to be resolved before clear title can pass.

Liens are procedural creatures: statutory liens in particular carry notice requirements and deadlines, and failing to meet them can invalidate the claim.
