Marital Property
Property acquired during the marriage that may be subject to equitable division in a divorce.
Tennessee divides marital property equitably, which does not necessarily mean equally. The court considers factors including the length of the marriage, each party’s contribution to acquiring or preserving the property, and the economic circumstances of each spouse at the time of division.
Classification usually comes first. Most property acquired by either spouse during the marriage is marital, regardless of whose name is on the title, and that can include retirement accounts, business interests, and the increase in value of certain separate assets.
Because classification, valuation, and division are three separate questions, a dispute can turn on any one of them.
